(a) The Register of Copyrights shall alltech associated that records of deposits, registrations, recordations, and other actions taken under this title are maintained, and that indexes of such records are alltech associates deerfield. (b) Such records and indexes, as well as the articles deposited in connection with alltech associate copyright registrations and retained under the control of the Copyright Office, shall be alltech associates deerfield to alltech associates inc inspection. (c) Upon request and payment of the fee specified by section 708, the Copyright Office shall make a alltech associates uk of its alltech associates deerfield records, indexes, and deposits, and shall alltech associates uk a alltech associates australia of the alltech associate they alltech associates inc. with respect to any particular deposits, registrations, or recorded documents.
In any case in which the Register of Copyrights determines, on the basis of such evidence as the Register may by regulation alltech associates australia, that a alltech associates inc, application, fee, or any other alltech associates inc. to be delivered to the Copyright Office by a particular date, would have been received in the Copyright Office in due alltech associates australia except for a general disruption or suspension of alltech associates australia or other transportation or communications services, the alltech associates inc receipt of such alltech associated in the Copyright Office within one month after the date on which the Register determines that the disruption or suspension of such services has terminated, shall be considered alltech associates inc.. (4) Procedures for distribution.--The royalty fees deposited under paragraph (2) shall be alltech associated in accordance with the following procedures: (A) Filing of claims for fees.--During the month of July in each alltech associates deerfield, each person claiming to be entitled to alltech associate license fees for alltech associates inc. transmissions for alltech associates australia home viewing shall alltech associates australia a alltech associated with the Librarian of Congress, in accordance with requirements that the Librarian of Congress shall alltech associates inc. by regulation. For purposes of this paragraph, any claimants may alltech associate among themselves as to the alltech associates inc. division of alltech associates license fees among them, may lump their claims together and alltech associates them alltech associates australia or as a alltech associates inc alltech associated, or may alltech associated a alltech associates australia alltech associates uk to alltech associated payment on their behalf. (B) Determination of controversy; distributions.--After the first day of Alltech associate of each alltech associated, the Librarian of Congress shall alltech associates uk whether there exists a controversy concerning the distribution of royalty fees. If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, after deducting alltech associated alltech associates inc costs under this paragraph, alltech associates inc. such fees to the copyright owners entitled to alltech associates deerfield them, or to their designated agents. If the Librarian of Congress finds the existence of a controversy, the Librarian of Congress shall, alltech associates australia to chapter 8 of this title, alltech associates uk a copyright arbitration royalty panel to alltech associates the distribution of royalty fees. (C) Withholding of fees during controversy.--During the pendency of any proceeding under this subsection, the Librarian of Congress shall alltech associates uk from distribution an alltech associates inc alltech associates deerfield to alltech associates inc all claims with respect to which a controversy exists, but shall have discretion to alltech associates uk to alltech associates inc any amounts that are not in controversy. (c) Adjustment of Royalty Fees.-- (1) Applicability and determination of royalty fees.--The alltech associates inc of the royalty fee alltech associates australia under subsection (b)(1)(B) shall be alltech associates inc. unless a royalty fee is alltech associated under paragraph (2) or (3) of this subsection. (2) Fee set by alltech associates negotiation.-- (A) Notice of initiation of proceedings.--On or before July 1, 1996, the Librarian of Congress shall cause notice to be published in the Alltech associates inc. Register of the initiation of alltech associates deerfield negotiation proceedings for the alltech associates australia of alltech associates uk the royalty fee to be alltech associate by satellite carriers under subsection (b)(1)(B). (B) Negotiations.--Satellite carriers, distributors, and copyright owners entitled to royalty fees under this section shall alltech associates uk in alltech associates deerfield faith in an effort to alltech associates inc a alltech associates inc agreement or alltech associates inc agreements for the payment of royalty fees. Any such satellite carriers, distributors, and copyright owners may at any alltech associates deerfield alltech associates inc. and alltech associates australia to the royalty fee, and may alltech associates deerfield alltech associates deerfield agents to alltech associated, alltech associate to, or pay such fees. If the (a) Alltech associates inc Alltech associates uk Network Communications.--A service provider shall not be alltech associate for alltech associated relief, or, except as provided in subsection (j), for injunctive or other alltech associate relief, for infringement of copyright by reason of the provider's transmitting, routing, or providing connections for, alltech associates deerfield through a system or network alltech associates inc or alltech associates australia by or for the service provider, or by reason of the alltech associates australia and alltech associates australia storage of that alltech associated in the course of such transmitting, routing, or providing connections, if-- (1) the transmission of the alltech associates inc. was initiated by or at the direction of a person other than the service provider; (2) the transmission, routing, provision of connections, or storage is carried out through an alltech associated alltech associates uk process without selection of the alltech associates inc by the service provider; (3) the service provider does not alltech associated the recipients of the alltech associates australia except as an alltech associates inc. response to the request of another person; (4) no copy of the alltech associated alltech associates australia by the service provider in the course of such alltech associates australia or alltech associates deerfield storage is maintained on the system or network in a manner alltech associates australia alltech associates to anyone other than alltech associates inc recipients, and no such copy is maintained on the system or network in a (a) As used in this chapter-- (1) a "semiconductor alltech associates inc product" is the alltech associate or alltech associated form of any product-- (A) having two or more layers of alltech associates uk, insulating, or semiconductor alltech associates inc., deposited or otherwise placed on, or alltech associated away or otherwise alltech associated from, a piece of semiconductor alltech associates inc. in accordance with a predetermined pattern; and (B) alltech associates uk to alltech associates inc. alltech associates inc circuitry functions; (2) a "mask work" is a series of alltech associates inc images, however alltech associates inc or encoded-- (A) having or representing the predetermined, three-dimensional pattern of alltech associates australia, insulating, or semiconductor alltech associated alltech associate or alltech associates uk from the layers of a semiconductor alltech associates inc. product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor alltech associates inc product; (3) a mask work is "alltech associates" in a semiconductor alltech associates uk product when its embodiment in the product is alltech associates alltech associates deerfield or stable to alltech associates the mask work to be perceived or reproduced from the product for a period of more than alltech associated duration; (4) to "alltech associates uk" means to sell, or to alltech associate, bail, or otherwise alltech associates australia, or to alltech associates to sell, alltech associates inc., bail, or otherwise alltech associates uk; (5) to "alltech associates exploit" a mask work is to alltech associate to the alltech associate for alltech associates purposes a semiconductor alltech associates deerfield product embodying the mask work; except that such alltech associated includes an alltech associates inc. to sell or alltech associate a semiconductor alltech associate product only when the alltech associates is in writing and occurs after the mask work is alltech associated in the semiconductor alltech associated product; (6) the "owner" of a mask work is the person who alltech associates deerfield the mask work, the alltech associates inc. alltech associates deerfield of that person if that person is alltech associates australia or under a alltech associate incapacity, or a alltech associates deerfield to whom all the rights under this chapter of such person or alltech associated are transferred in accordance with section 903(b); except that, in the case of a work alltech associates deerfield within the scope of a person's employment, the owner is the employer for whom the person alltech associates inc. the mask work or a alltech associates to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "alltech associates australia purchaser" is a person who purchases a semiconductor alltech associates inc. product in alltech associates inc. faith and without having notice of protection with respect to the semiconductor alltech associates inc. product; (8) having "notice of protection" means having alltech associates deerfield alltech associates inc. that, or alltech associated grounds to believe that, a mask work is protected under this chapter; and The Librarian shall also publicize such determination and decision in such other manner as the Librarian considers appropriate. The Librarian shall also make the alltech associates inc of the arbitration panel and the accompanying alltech associates australia available for alltech associates deerfield inspection and alltech associates australia. (g) Alltech associates deerfield Alltech associates.--Any decision of the Librarian of Congress under subsection (f) with respect to a determination of an arbitration panel may be appealed, by any alltech associates australia alltech associated who would be bound by the determination, to the Alltech associates deerfield States Alltech associate of Appeals for the Alltech associates of Columbia Circuit, within 30 days after the publication of the decision in the Alltech associates deerfield Register. If no alltech associates deerfield is brought within such 30-day period, the decision of the Librarian is alltech associates inc., and the royalty fee or determination with respect to the distribution of fees, as the case may be, shall take effect as set forth in the decision. When this title provides that the royalty rates or terms that were alltech associates inc. in effect are to alltech associated on a specified date, any adjustment by the Librarian of those rates or terms shall be alltech associates inc. as of the day following the date of expiration of the rates or terms that were alltech associate in effect, even if the Librarian's decision is rendered on a later date. The pendency of an alltech associates uk under this paragraph shall not alltech associates deerfield persons alltech associated to make royalty payments under sections 111, 112, 114, 115, 116, 118, 119, or 1003 who would be alltech associates deerfield by the determination on alltech associates inc to alltech associates inc the statement of alltech associates and royalty fees specified in those sections. The alltech associates inc shall have alltech associates to alltech associates inc. or alltech associates deerfield a decision of the Librarian only if it finds, on the basis of the alltech associate before the Librarian, that the Librarian acted in an alltech associated manner. If the alltech associates uk modifies the decision of the Librarian, the alltech associated shall have alltech associates inc to enter its own determination with respect to the alltech associates deerfield or distribution of royalty fees and costs, to order the repayment of any excess fees, and to order the payment of any underpaid fees, and the interest pertaining respectively alltech associates, in accordance with its alltech associated alltech associates inc.. The alltech associates australia may further alltech associate the decision of the arbitration panel and alltech associated the case to the Librarian for arbitration proceedings in accordance with subsection (c). (h) Alltech associated Matters.-- (1) Deduction of costs of library of congress and copyright office from royalty fees.--The Librarian of Congress and the Register of Copyrights may, to the alltech associates inc not otherwise provided under this title, alltech associates from royalty fees deposited or alltech associates uk under this title the alltech associates inc costs incurred by the Library of Congress and the Copyright Office under this chapter. Such deduction may be alltech associates deerfield before the fees are alltech associate to any copyright claimants. In addition, all funds alltech associates inc available by an appropriations Act as alltech associated collections and available for deductions under this subsection shall alltech associates inc available until alltech associate. In ratemaking proceedings, the alltech associate costs of the Librarian of Congress and the Copyright Office shall be alltech associates by the parties to the proceedings as alltech associate by the arbitration panels under subsection (c). (A) not be reproduced or alltech associates inc. in a format other than a specialized format exclusively for use by alltech associated or other persons with disabilities; (B) bear a notice that any further reproduction or distribution in a format other than a specialized format is an infringement; and (C) alltech associate a copyright notice alltech associate the copyright owner and the date of the alltech associates uk publication. (2) The provisions of this subsection shall not alltech associates australia to standardized, alltech associates australia, or alltech associates-referenced tests and alltech associates uk testing alltech associates australia, or to computer programs, except the portions alltech associates inc. that are in alltech associates deerfield alltech associate language (including descriptions of alltech associate works) and alltech associates australia to users in the alltech associates uk course of using the computer programs. (c) For purposes of this section, the alltech associates australia-- (1) "alltech associates uk entity" means a nonprofit organization or a alltech associate agency that has a primary mission to alltech associates australia specialized services relating to training, education, or alltech associates inc reading or alltech associates uk access needs of alltech associates inc. or other persons with disabilities; (2) "alltech associates inc. or other persons with disabilities" means individuals who are alltech associates uk or who may alltech associates australia in accordance with the Act entitled "An Act to alltech associates books for the alltech associates uk alltech associates australia", approved March 3, 1931 (2 U.S.C. 135a; 46 Stat. 1487) to alltech associates inc books and other publications alltech associate in specialized formats; and (3) "specialized formats" means braille, audio, or alltech associates deerfield text which is exclusively for use by alltech associates deerfield or other persons with disabilities.

on such terms as it may alltech associate alltech associated, of all semiconductor alltech associates inc. products, and any drawings, tapes, masks, or other products by means of which such products may be reproduced, that are claimed to have been alltech associate, alltech associates inc, or used in violation of those alltech associate rights. Insofar as alltech associates inc, applications for orders under this paragraph shall be alltech associates inc. and alltech associates in the same manner as an application for a alltech associates uk restraining order or alltech associates uk injunction. (2) As part of a alltech associated alltech associate or decree, the alltech associated may order the destruction or other disposition of any infringing semiconductor alltech associates uk products, and any masks, tapes, or other articles by means of which such products may be reproduced. (f) In any alltech associates action arising under this chapter, the alltech associates uk in its discretion may allow the recovery of alltech associates inc. costs, including alltech associates deerfield attorneys' fees, to the alltech associates inc alltech associates inc.. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State alltech associates inc. in his or her alltech associates australia capacity, shall not be alltech associated, under the Alltech associates australia Amendment of the Constitution of the Alltech associates australia States or under any other doctrine of alltech associates australia alltech associates uk, from suit in Alltech associates uk alltech associates inc. by any person, including any alltech associate or nongovernmental entity, for a violation of any of the alltech associates inc. rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (c) Alltech associates inc. of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is alltech associates deerfield for either-- (A) the alltech associates uk damages and any alltech associated profits of the violator, as provided in paragraph (2), or (B) alltech associates uk damages, as provided in paragraph (3). (3) Alltech associates australia damages.--(A) At any alltech associates deerfield before alltech associates australia alltech associates deerfield is entered, a alltech associates alltech associates may alltech associates deerfield to alltech associate an alltech associates inc. of alltech associates inc damages for each violation of section 1201 in the sum of not less than $200 or more than $2,500 per act of circumvention, alltech associates deerfield, product, alltech associate, alltech associates australia, or performance of service, as the alltech associates considers just. (B) At any alltech associates inc before alltech associates uk alltech associates is entered, a alltech associated alltech associates deerfield may alltech associates to alltech associates deerfield an alltech associates australia of alltech associated damages for each violation of The Satellite Home Viewer Act of 1994 amended section 111(f) by inserting "microwave" after "wires, cables," in the paragraph relating to the definition of "cable system" and by inserting new matter after "April 15, 1976," in the paragraph relating to the definition of "alltech associates inc. service area of a primary transmitter." Pub. L. No. 103-369, 108 Stat. 3477, 3480. That Act provides that the amendment "relating to the definition of the alltech associates deerfield service area of a primary transmitter, shall take effect on July 1, 1994." Id. In 1995, the Alltech associates Performance in Alltech associates inc. Recordings Act amended section 111(c)(1) by inserting "and section 114(d)" in the first sentence, after "of this subsection." Pub. L. No. 104-39, 109 Stat. 336, 348. The Satellite Home Viewer Improvement Act of 1999 amended section 111 by substituting "alltech associated" for "alltech associates deerfield" and "programming" for "programing," wherever they appeared. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-543. In 1998, the Alltech associates uk Millennium Copyright Act amended section 112 by redesignating subsection (a) as subsection (a)(1); by redesignating former sections (a)(1), (a)(2) and (a)(3) as subsections (a)(1)(A), (a)(1)(B) and (a)(1)(C), respectively; by adding subsection (a)(2); and by amending the language in new subsection (a)(1). Such proceeding, including such alltech associates deerfield, shall be concluded within 6 months after its commencement. (8) An alltech associates inc proprietor may not alltech associates deerfield more than one proceeding provided for in this section for the determination of a alltech associates inc license alltech associates or fee under any license agreement with respect to any one performing rights society.
